CONDITIONS FOR USING THE ON-LINE FLAT RESERVATION SYSTEM

THE ON-LINE FLAT RESERVATION SYSTEM is operated by redNet Investment Sp. z o.o. a Polish registered company with its registered office in Jaworzno at ul. Sądowa 5, 43-600 Jaworzno; operating on the basis of an entry in the register of companies maintained by the District Court in Katowice, Commercial Department of the National Court Register with KRS no. 0000226990, hereinafter referred to in the Regulations as the Operator. A condition of using the FLAT RESERVATION SYSTEM on the www.klubinwestora.tabelaofert.pl portal is the acceptance of all the conditions of the Regulations given below. Acceptance is a pronouncement of will and creates a legal obligation between the User and the Operator. The User is authorised to copy, reconstruct and record free of charge these Regulations.

1. DEFINITIONS

Developer - investor (developer, housing association or other entity offering the purchase of properties on preferential terms). Information Package - a document available for Users describing Real Estate and Properties. Real Estate, Properties - the complex of building offered by Developers, housing associations as well as other entities described in the Information Package together with the separate parts (Properties). FLAT RESERVATION SYSTEM on-line (hereinafter referred to as the System) - the program allows Users to read the Information Package, on the basis of which they can reserve Properties. User - a person using the System.

2. GENERAL RESOLUTIONS

1. System is made available by redNet Investment Sp. z o.o., a Polish registered company with its registered office in Jaworzno at ul. Sądowa 5 operating on the basis of an entry in the register of companies maintained by the District Court in Katowice, Commercial Department of the National Court Register with KRS no. 0000226990
2. This document defines the rules which comprise the legal basis for using Users to use the System.
3. Each User is obligated, at the moment of using the System, to observe these Regulations.

3. USER'S RESPONSIBILITIES WHEN USING THE SYSTEM

1. The User confirms that he is fully able to undertake legal actions and to create legally binding obligations, thus in accepting the undermentioned conditions he accepts full financial responsibility for using the System.
2. The User assures that he will use the System in order to read the Information Package as well as make a purchase of a Property, exclusively in way that is in accordance the binding law, avoiding any kind of action directed towards the investigation of erroneous claims.
3. It is forbidden for the User to use the System using another or false name. The User is obligated to use the System exclusively in his own name and for his own needs.

4. PROTECTION OF PERSONAL DATA and REGISTRATION IN THE SYSTEM

1. The Operator respects in full the right to privacy and the protection of the personal data of the User and by this declares that he will not make information about the User available to third parties besides data provided to the Developer in accordance with these Regulations.
2. In the event of using the System made available at www.klubinwestora.tabelaofert.pl, Users will be asked to provide personal data necessary to register and log on to the System and make use of the data found there including, in particular, the Information Package.
3. When using the System, the User provides information about himself. This information is collected in the Operator's database and is used exclusively by the Operator and also makes possible an analysis of Users' needs.
4. The Operator makes every effort for Users of the System to have full access to information on www.klubinwestora.tabelaofert.pl.
5. In connection with this, the Operator reserves the right to inform Users about all Real Estate/Property offered by the Operator in the System.
6. The User can resign at any moment from the information option described in point 5 by sending a resignation request to inwestycje@tabelaofert.pl.
7. By accepting these Regulations, the User confirms the correctness of the personal data provided by him and in accordance with article 23 of the act on the protection of personal data from 29.08.1997 expresses agreement for these data to be stored and processed in the data base of the System. Users have the right to look at and modify their personal data.

5. PROCEDURE: READING THE INFORMATION PACKAGE, MAKING RESERVATIONS, ALLOCATION OF PROPERTIES.

1. Receiving information about Real Estate/Properties
   The User receives to his e-mail address information about the web address and access code to the protected area of the site. After logging on by the User to the System, he will see the following data connected with the Real Estate/Property: city where the Real Estate is, what type of building the Real Estate is, the special price for the User together with discount.
2. Information Package
   If the User is interested in Real Estate/Property, he logs on to the System and download the Information Package describing the Real Estate/Property. The Information Package is made up of at least the following data:
   1. General information about the city and market;
   2. Information about the location;
   3. Information about the developer;
   4. Information about the project;
   5. A collection of selected properties together with prices;
   6. Information about the local rental market;
   7. Information about the options for financing the purchase of the Property - mortgage providers;
   8. Buying procedure - payment;
   9. Samples of documents
3. Reservation
   The User makes a reservation by selecting one or a greater number of Properties in the Real Estate by entering into the appropriate questionnaire all required data. The User makes a reservation within the period defined in the Information Package.
4. Confirming the reservation
   The User receives a confirmation to the email address supplied by him of the reservat on of Properties together with information about where they are located.
5. Procedure for allocating Properties
   The Operator makes the allocation of reserved Properties and informs the User about this on the basis of the order in which properties were reserved taking into account the history of cooperation to date. From the moment of allocating a property to a User, the User is obligated to pay for the Information Package for each reserved property within the period of 4 working days from receiving the information about the allocation. Reservation is effective on condition that payment of the fee described above is made within the period of 4 working days from receiving information from the Operator about the allocation of the Property. If the User does not make payment within the period of 4 working days from receiving the information from the Operator about the allocation of the Property, the Property will be allocated to the next User on the waiting list.
6. Forms of payment
   The following forms of payment are accepted for reading the contents of the Information Package and having a Property allocated:
   1. bank transfer;
   2. payment in cash in at the Operator's office in Warsaw at ul. Sierpnia 6a Budynek C
   Cash payments and bank transfers should be made to the account: redNet Investment sp. z o.o. ul. Sądowa 5, 43-600 Jaworzno; Bank BPH account no.: 52-10600076-0000320001008084 The first name and surname of the User as well as the reservation number of the User should be given in the case of bank transfers.
7. Confirmation of allocation of the Property with the Developer
   After making payment on time to the Operator, the Operator passes to the Developer information about the allocation of Property to the User, giving him all the User's contact information as well as passing to the User the contact information of the Developer.
8. Annulling the reservation
   The User can annul the reservation of a Property at any time, although the amount paid by the User for reading the Information Package and the allocation of the Property is non-refundable.

6. COMPLAINTS

Complaints about the functioning of the System can be made up to 7 days from the occurrence of an event in written form to the Operator's office in Warsaw, at ul. Sierpnia 6a Budynek C, or by e-mail to the address: inwestycje@tabelaofert.pl The Operator will inform the User about receipt of the complaint and the time for its investigation within 3 days of receiving it.

7. RESPONSIBILITY

1. Data for the Information Package as well as information contained in it was gathered with maximum reliability and care. However, the conclusions and interpretations published in the Information Package are the personal views of the authors and should be treated as such. The authors as well as the Operator warn that they do not bear any responsibility for investment decisions taken by the User on the basis of the Information Package.
2. The Operator does not bear any responsibility for:
   • data not disclosed by the Developer when creating the Information Package;
   • changes made by the Operator or people acting in its name after the Information Package and/or its parts were prepared;
   • parts of the Information Package created by independent entities (law offices, surveyors etc).
3. The Operator warns that using the System takes place exclusively at the cost and risk of the User. The Operator does not give any guarantee that there will not be any faults, flaws, pauses or stoppages in connecting to the System nor that the contents, accuracy or usefulness of the Information Package will meet the expectations of the User.
4. The user recognizes that all copyrights, all trademarks as well as all remaining property rights connected with the Information Package belong to the Operator. Using these rights for purposes other than those strictly connected with using the System is forbidden.
5. The Operator does not bear any responsibility to the User nor to third parties for any direct or indirect losses or damages or loss of data, profits, income or companies, irrespective of the cause, even if the Operator could have predicted such loss or damage or was informed about such a possibility.
6. Not limiting the content of previous, the Operator's liability, in accordance with these regulations (resulting from neglect or another cause), cannot in any event exceed 2000 EURO irrespective of the number of reservations made.
7. The Operator reserves the right to transfer or commission all or part of its rights and responsibilities resulting from this Agreement. The User cannot make legal transfer of rights and responsibilities to third parties without the written permission of the Operator.

8. FINAL RESOLUTIONS

The Operator reserves the right to annul the User's reservations and to withdraw from the agreement without giving any reason with the return of amounts paid by the User.
The Operator reserves the right unilaterally to make changes to the contents of these Regulations. Each User is obligated to read the Regulations before logging on to the System, downloading the Information Package and making reservations and each time is bound by the Regulations from the moment of downloading the Information Package.
